OAKLAND — A 26-year-old man has been arrested and charged with murder in connection with a May 20 shooting that occurred a short distance from Oakland’s City Hall, court records show.
The suspect, San Pablo resident Daniel Zuniga, was charged with murder, shooting at an occupied vehicle, and carrying a concealed weapon in public. Police say that Zuniga was driving a Volvo and fired into a Jaguar containing the homicide victim, 36-year-old Sebastian Lumsey, and a second man who jumped out of the moving vehicle as the shots were fired.
The shooting occurred around 8:20 p.m. on May 20, on the 500 block of 14th Street, near Clay Street. Police say the Jaguar was navigating around some traffic cones down the street and sideswiped the Volvo, angering Zuniga and motivating him to chase down the Jaguar and open fire.
Zuniga was arrested on suspicion of murder in late May but later released without charges. When authorities gathered more evidence and re-arrested him in June, he was also booked on suspicion of intentionally damaging a police vehicle and briefly placed in a mental health hold, according to jail records.
The primary evidence against Zuniga is video surveillance showing the shooter wearing a specific outfit that was later found in Zuniga’s possession, according to police. Authorities also say the Volvo was found at his San Pablo home.
Zuniga is being held without bail and is not due in court to enter a plea until July 9, records show.
